Due to copyright laws, we are unable to scan any professionally taken image that is copyright protected. This includes pages from books, magazines, and postcards as well as professionally shot portraits, wedding photos and school photos. These images will not be scanned. NO EXCEPTIONS without a valid copyright release from the photographer. We do validate all copyright release forms.
If you are unsure if a photograph is copyright protected, there are a number of ways to note this, however the most common methods are:
- the photograph is printed on paper that notes "Do not copy", "Professional Copyright" or some other text on the back noting it was printed on professional grade paper
- the photograph has the name of the photographer or studio printed on the front. This was most common with Olsen Mills photographs
- the photographers name or copyright symbol is imprinted or stamped on the back of the photograph
As a frame of reference, copyright protection lasts for 70 years AFTER the death of the photographer so unfortunately, even those photos from the 80's, where the studio is no longer around, are still copy protected. Additionally, work created between 1964 and 1978 are protected for 95 years from the creation date. Since it would take ScanMyPhotos too long to confirm the copyright status of each photo that arrives in our facility, any and all photos that have some sort of copyright notice on them WILL NOT be scanned without prior proper authorization from the photographer.
Any unauthorized copy protected material will be return to you unscanned and without compensation for rescans (if sent in the prepaid photo scanning box). It is your responsibility to be aware of the material you are sending to ScanMyPhotos.com.
ADDITIONAL INFORMATION
As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years. For an anonymous work, a pseudonymous work, or a work made for hire, the copyright endures for a term of 95 years from the year of its first publication or a term of 120 years from the year of its creation, whichever expires first. Work created between 1964 and 1978 have a 28 year original term, plus 67-year renewal term, which vests automatically without registering the renewal (a total of 95 years protection from the time of creation).
